Am 5.7.2007 wurde mir der Beschluss des BVerfG vom 8.5.2007 zugestellt. Ich war Ausgangskläger in 6 der 7 (noch zur Entscheidung anstehender) Vorlageverfahren.
Der Beschluss 2 BvM 1-5/ und 2 BvM 1-2/06 is t hier abrufbar (Achtung ca 900 KB gross).
Ausführliche Diskussion und Hintergründe sind in der Kommentierung von Stefan Engelsberger (Interessengemeinschaft Argentinien - IGA -) nachzulesen.
Das BVerfG hat ganz elegant die Problematik weitere Feststellungen zu Staatsnotstandsfragen umgangen. Durch die Formulierung der Vorlageverfahren (ob eine Wirkung gegenüber Privaten etnfaltet wird) konnte es sich die Prüfung relativ einfach machen....

Ein Mitstreiter von mir hat auf einen sehr wichtigen Aspekt hingewiesen! Sollte es so sein, dass der Generalstaatsanwalt may grant the Treasury (Procurador General del Tesoro) to Argentine law a German lawyer for the processes carried out in Frankfurt no power of attorney, could fail because of the exequatur formal. The article in the Argentine daily newspaper of 01/11/2003 must also be seen in this light.
I (a CONT colleagues of mine) have examined the case law on the issue and added the relevant authorities as an investment. The key messages are:
1) The legal representative of the foreign tax authorities in the process is governed by the laws of the foreign state (BGH, Judgement of 23.10.1963 - V ZR 146/57).
2) The power of representation a permanent representative ... From its offices in England, power of attorney for litigation before German courts grant is to be judged according to English law (BGH, Judgement of 04/26/1990 - VII ZR 218/89).
RA Strba is currently well without a valid power of attorney, so that Argentina would be condemned by default judgment, provided proper authorization will not be filed later. A process of action, carried out without effective power of attorney and also not approved is effective, ineffective. One is without authority pickled appeal as inadmissible (discard BGH, decision of 11.26.1953 - IV ZR 27/53, Judgement of 08.05.1990 - VI ZR 321/89, NJW 1990, 3152).
„Im internationalen Rechtsstreit gilt § 88 Abs. 2 ZPO nicht: Der Mangel der Vollmacht der beklagten ausländischen Partei ist von Amts wegen zu berücksichtigen; Grund: Vermeidung von im Auftreten eines vollmachtlosen Vertreters liegenden Anerkennungshindernis“, vgl. Zöller, § 88, Rn. 3 a.
Die Sache besitzt somit hohe Brisanz, da im Zöller ausdrücklich auf ein Anerkennungshindernis hingewiesen wird. Wir sollten daher für alle unsere laufenden Prozesse sicherstellen, dass eine wirksame Prozessvollmacht vorliegt.
Der Mangel der vorliegenden Vollmacht muss nach § 88 ZPO gerügt werden. Hierfür wären der spanische Originaltext und eine Übersetzung dieses Gesetzes, welches den Umfang der Vertretungsmacht des Procurador General del Tesoro regelt, erforderlich. Ich wäre Rolf bzw. NN dankbar, wenn ihr diese Infos zur Verfügung stellen könntet.

These greetings come from far away though, but still I am sitting in the boat. I also complain of Paraguay from Germany in order to obtain an enforceable title against Argentina. However, stimulated by their interesting contributions in the Wiebel-Forum.

Mr. Koch, to your birthday today, I wish you all the best and much continued success.
These greetings come from far away though, but still I am sitting in the boat. I also complain of Paraguay from Germany in order to obtain an enforceable title against Argentina. However, stimulated by their interesting contributions in the Wiebel-Forum.
For me, all your activities, contrary to many reviewers, is always very valuable. Sie haben nicht nur ein Geschäft aus der Argentinienmiesserie gemacht, sondern auch das Verständnis für die juristischen Schwierigkeiten und Lösungen geweckt.
Ich wünsche Ihnen, dass Sie an Ihrem bisherigen Weg und Einsatz unbeirrt festhalten und weiterhin das Forum mit Ihren interessanten Beiträgen bereichern, damit diese Art von weltweitem Informationsaustausch für Argentinien ein Reinfall wird.

Wir suchen ein neues zu hause, aber keiner kann uns bisher helfen...
ich beschreibe mal wie wir jetzt wohnen...
Unsere Wohnung ist nicht rollstuhlgerecht gebaut, meine Mama muß mich
immer durch die Wohung tragen und da ich nicht mehr die Kleinste
und Leichteste bin, hat sie jetzt auch schon Rückenprobleme...
Das Badezimmer ist so klein, wie eine Einbahnstraße
und 5 Tage die Woche gibt es vor 9 Uhr kein warmes Wasser bei uns...
Im Winter ist es in der Wohnung nur lau warm, because the heating does not

takes it in the stairwell because roommates are too lazy to close the door.
We live north side, so that we in the hot sun does not gotten much
, outside it is usually warmer than in our apartment ...

Sicher fragt ihr euch, was ich denn für ein Krankheit habe,
ich versuche es mal zu erklären:
Sie nennt sich “Tuberöse Sclerosis with cerebral seizures "

The doctors told my mom, I would probably not reach the 2nd birthday ...
followed months of hospital stay ... I was the purest drugs guinea pig, as you all are tried, up through which also helped, well unfortunately always a certain time, then my body got used to it and we had to try new ....

"Jessica aß vom Löffel, als sie mal wieder ins KH mußte wurde sie dort mit “Gewalt” gefüttert einige Erwachsene Schwestern gegen ein kleines Kind das sich nicht wehren konnte, so verweigerte sie (was mich nicht wundert) den Löffel und ich mußte sie wieder feed the baby bottle, well it was then denied, reason I had her they're on the world drug was always given by force and against their will, with increasing age was also increasingly difficult, until one day just the baby-bottle refused ... until the doctors agreed to be the Peg .... "
And now you know why my mom is around the clock for me ...

ich versuche es mal zu erklären:

Warum eine Magensonde, wird man sich nun fragen… ??!!!
Mama erklärt es:
"Jessica aß vom Löffel, als sie mal wieder ins KH mußte wurde sie dort mit “Gewalt” gefüttert einige Erwachsene Schwestern gegen ein kleines Kind das sich nicht wehren konnte, so verweigerte sie (was mich nicht wundert) den Löffel und ich mußte sie wieder feed the baby bottle, well it was then denied, reason I had her they're on the world drug was always given by force and against their will, with increasing age was also increasingly difficult, until one day just the baby-bottle refused ... until the doctors agreed to be the Peg .... "
And now you know why my mom is around the clock for me ...

Hallo ich heiße Jessica - Silvia und erblickte am 02.06.1999 die Welt,
ich bin nicht gesund, aber habe genauso eine Freude am Leben wie jedes andere Kind, meine Mami kümmert sich Tag und Nacht um mich und ist immer für mich da, wenn ich Bauchweh habe, oder wieder mal eines meiner Zähnchen einschießt und ich ganz arg weinen muss, nimmt sie mich in den Arm und tröstet mich...
ich kann nicht laufen aber meine Mama nimmt mich überall mit hin...
ich kann nicht essen aber meine Mama gibt mir immer etwas wo ich drauf rum kauen kann.
Ich bin ein lebensfrohes kleines Mädchen, be very happy to play with other children, especially like I go into the disabled facilities, there are many children who are like me.
